Terms of Use
Last updated: 6 November 2026
These terms apply to your use of NURISTAY, a cloud property management service for accommodation providers in New Zealand, and to this website. They are an agreement between you (the business that subscribes) and [Company name to be confirmed] (“we”, “us”), which operates NURISTAY.
1. Who these terms are for
NURISTAY is designed for businesses. By using it you confirm that you are acting for a business and that you have authority to accept these terms for that business.
Your staff who use NURISTAY under your account must follow these terms. You are responsible for what they do in NURISTAY.
2. Your account
We set up your property and your owner login. The owner can then add team logins for staff. Each login is for one person and one business only.
Keep passwords and PINs private. NURISTAY signs in with a password and then a PIN. Tell us straight away at [email protected] if you think a login has been misused.
Give us accurate information, and keep your property and contact details up to date.
3. Subscription and fees
NURISTAY is a subscription. The plan is chosen by the number of rooms at your property, and the Office Add-on is optional. Current plans and prices are shown on our Plans page.
- Prices are in New Zealand dollars and exclude GST, which we add where it applies.
- The subscription is paid by the month. If you pay for 12 months at once, a 12% discount applies.
- We send you an invoice. We record your payment and extend the date your subscription is paid until.
- If a subscription is not paid by its due date, you have a 30-day grace period. After that NURISTAY becomes read-only (you can view and print, but not change data) until the subscription is paid.
- We may change plans and prices by giving you at least 30 days’ notice. The change applies from your next paid period.
Fees already paid are not refundable, except where the law requires it or we agree otherwise.
3A. Demo and testing
We may give you access to a demo property. It is for trying NURISTAY only. Do not enter real guest information in a demo property.
4. Your data
You own the information you and your guests put into NURISTAY (your “data”). We do not claim ownership of it.
You give us permission to store and process your data only to provide NURISTAY to you, to keep it secure and working, and as our Privacy Policy describes.
You are responsible for your data. In particular you must have a lawful reason to collect guest information, tell your guests how you use it (a privacy notice), and respond to your guests’ requests about their own information. For guest information, you decide why and how it is used and we process it for you.
You can ask us for a copy of your data at any time. When your subscription ends, we will delete or return your data within a reasonable time on request, except for records we must keep by law.
5. Acceptable use
You must not:
- break the law, or use NURISTAY to collect information you are not allowed to collect;
- share your login with other businesses, or let people who are not your staff use it;
- try to access data that is not yours, or interfere with or overload NURISTAY;
- copy, resell or reverse-engineer NURISTAY, or use it to build a competing product;
- upload anything harmful, such as malware.
We may suspend access if you break these rules or put NURISTAY or other customers at risk. We will tell you why when we reasonably can.
6. Third-party services
NURISTAY can connect to services we do not control, for example Stripe (payments), Microsoft 365 (email), and booking channels such as Booking.com and Expedia through our channel connection provider. Your use of them is under their own terms. We are not responsible for their availability or for what they do.
7. Availability and support
We work to keep NURISTAY available and secure, but we cannot promise it will always be uninterrupted or error-free. We may carry out maintenance, and we may change or improve features.
Support is provided by email at [email protected].
8. Our intellectual property
We own NURISTAY, including its software, design and name. You may use it only as allowed by these terms while your subscription is current.
9. What NURISTAY is not
NURISTAY is a tool to help you run your business. Its documents, reports, tax figures and payroll features are not legal, accounting or tax advice. You are responsible for checking them, including your GST, tax and employment obligations, and for your own business decisions.
10. Warranties and liability
To the extent the law allows, NURISTAY is provided “as is”, and we give no warranties beyond those in these terms.
You and we both acknowledge that NURISTAY is supplied and acquired for the purposes of a business. To the extent the law allows, the Consumer Guarantees Act 1993 and sections 9, 12A and 13 of the Fair Trading Act 1986 do not apply, and you agree it is fair and reasonable to contract out of them.
To the extent the law allows, we are not liable for indirect or consequential loss, or loss of profit, revenue, bookings or data, however it arises.
Our total liability to you for all claims relating to NURISTAY in any 12-month period is limited to the fees you paid us in the 12 months before the claim arose.
Nothing in these terms limits liability that cannot lawfully be limited.
11. Ending the subscription
You can cancel at any time by giving us 30 days’ written notice. We may end your subscription by giving you 30 days’ notice, or straight away if you seriously or repeatedly breach these terms or do not pay after the grace period.
When a subscription ends, section 4 applies to your data. Sections that by their nature continue (such as liability and governing law) continue.
12. Changes to these terms
We may update these terms. If a change is significant, we will tell you by email or in NURISTAY at least 30 days before it takes effect. If you keep using NURISTAY after that, you accept the new terms.
13. General
These terms, with our Privacy Policy and the Plans page, are the whole agreement between us about NURISTAY.
These terms are governed by New Zealand law, and the courts of New Zealand have jurisdiction.
